Urgent legal corrections required in Forbesganj police firing case


It’s around a month since Forbesganj police firing took place in which four people were killed by Bihar police. Nothing much has happened when it comes to the judicial enquiry except the fact that, terms of reference of the judicial enquiry has been announced by the government of Bihar.
Legally speaking there are several lacunas in the case as presented by the victims before the Chief Judicial Magistrate, Araria. According to Bilal Kagzi, member of Legal Volunteers, a legal NGO, there is an urgent need to correct legal course of the case otherwise the case might collapse in favor of the accused.

First and for most, legal steps should be taken in order to ensure that there is just one FIR from the side of the villagers. At present, three separate complaints have been filed by the victims before the Chief Judicial Magistrate. Farooq Ansari, Phatkan Ansari and Rafiq Ansari, kins of those killed by the police, had to approach the CJM to file their complaint when the local police refused to register their FIRs. In normal cases the CJM could have ordered the police to register the FIR but the CJM kept the enquiry to himself.
Now Kagzi says that three separate complaints might end up creating contradictions in the case. So first of all the victims should get their complaints clubbed by filing a petition before the Patna high court and plea the court to direct the police to register an FIR.
Kagzi, who has studied the complaints filed by the victims, says that they should have mentioned the specific roles of the accused in the complaints. For instance out of fear and scare of the local police, the victims didn’t dare to name Garima Malik, the Superintendent of police who was present on the spot when the firing happened. They should include this very important missing element in case a FIR is registered on the orders of the high court. There are enough evidences to suggest her culpability and complicity in the firing in the form of the video which shows her present when Sunil Yadav was jumping on the face of Mustafa Ansari.
The second biggest problem of the case is the three FIRs against the villagers registered by the local police, Auro Sundaram and the block officer. Legal experts say that the villagers should get the FIRs quashed by filing a petition before Patna high court.
What makes the legal correction urgent is the discriminatory behavior by the local police in the whole episode. For instance when the victims went to police station police the local police refused to file FIR against the accused which include some police officers also.
On the other hand, allegedly the same police suggested Sunil Yadav, how to defend himself. Police registered an FIR by Yadav against unknown villagers charging them of attacking him from behind. Yadav is the same policeman against whom after much pressure the police had to file an FIR charging him with murder of Mustafa Ansari.

My Life at a glace..

It was 31st July 2007 when all this started. Me and Aftab were wondering in around Jamia Campus when all this began.. I was realy very interested in Tourism & Travel, surfing new sights and making career in tourism Industry without knowing the Industry closely.. This was Aftab only who convinced me more about the same..This was the last day of submission of the form for the Course Tourism & Travel Management at Jamia Millia Islamia University and the time was exactly the 1600 Hrs. Suddenly I decided to fill the form for the same when only a single hour was remaining in closing the receiving of the application form. Aftab advised me to fill the form and I agreed.. We went to Jamia Makhtab to get an Application Form paying a sum of Rs. 200/-. We went to Tourism Dept. to submit the Duly filled form. It was already 1715 Hrs(We were late). After a short conversation with Prof. Inayat Ali Zaidi(Dean. Of Faculty of Humanities & Language co. Co-Ordinator of Tourism Dept.) I managed to submit the form. It was 12th Aug 2007 when I had the written entrance exam. I was confident of being shortlisted  for the Interview & G.D and was shortlisted. 119 candidated were called for Interview followed by G.D  for 30 Seats. I was not realy sure of making through this challege because there were only 15 Seats for General Cateogry. I was satisfies with my Interview session and dominated the G.D as a result I was shortlisted in the Fresh List in the General Cateogry. 

                                                   Now it starts the Jamia Life and I came to know what actualy Tourism Indutry is all about. Obviously we were the best 30 among thousands applied for the course. There were two withdrawals from the course One was Cinthya Guite & another one Deepak Negi. Deepak withdrawn in the very beginning while Cinthya's dad expired meanwhile and she went back to Manipur. I had one one of the best academic session of my life that was 2007-2008. In the end of the year we had a Training programme by Ministry of Tourism & Culture Govt. of India named "Earn While You Learn ". 60 Candidates were shortlisted among the thousands & successfully i made through it. Training Program Inaugurated on 24th Dec 2007 & Lasted till 13th Jan 2008. Our Training Hels at Indian Institute of Tourism & Travel Management, Pusa. We had a tour to Agra & Fatehpur Sikri during our training. This traing was all about sensitizing youth towards Tourism & on behalf of this training program we were selected as the Student Volunteers for 19th Commonweralth Games Delhi 2010. After suucessfully completion of the Training program we were certified and given a stipen of Rs. 1000/- by Mininstry of Tourism & Culture Govt. of India.  Once again Jamia life comes back on track after enjoying the Training during the winter vacations.
It was the time to come close to the couligues. We started bunking classes. We used to play some adventurous games during  free time. like Truth & Dare etc. These were the games through which we actualy came to know about each other. Some of my best friends of the time are Gaurav Kumar Gupta, Sandeep Sehwag, Khalid Wani, Arshi Khan, Shahida Bano, Zaki Azfar, Atif Kidwai, Zeeshan Khan, Sharvat Ali Tomer, Kim, Zeeshan Alam, Zeeshan Khan, Tabassum Badar, Aiyaz Mehmood, Toushif, Vikrant Bhandari, Punam Singh, Roopa, Hanshika Rai, Anshita Mathur, Quamar Reza, Shams, Samiya Khan etc.  

We had a college Tour to Rajasthan from 8th -15 March  2008. Destinations included in our Itinerary were, Jaipur, Chittorgarh, Udaipur, Mount. Abut, Jodhpur, Ajmer & Pushkar. We enjoyed a lot during our tour.
After the tour it was the time to make project on the Places covered during our tour and highlight the places of tourist interest. Now the serious time comes when we had the Headache of Exam. Exam passed all goodand we all 30 were successful. 11 of us stood with 1st Division and and fortunately I was among the 11.
Now the real competition started and every one was stressful to make through the entrance for Diploma in Tourism & Travel Management, again there were only 30 seats & 24 of us had applied for the same. Competition was realy very tough this time as compared to previous year. and finally 17 out of 24 were successful to get admission in DTTM and I was among the the 17.
